Effective date: January 1, 2026
These Terms & Services ("Terms") govern your access to and use of hometowntodowntown.com (the "Site") operated by HomeTown to Downtown ("Company," "we," "us," or "our"), and they describe important conditions related to our home improvement, remodeling, repair, and consultation services ("Services"). Please read these Terms carefully before using the Site or engaging us for work.
By accessing the Site, submitting a form, or requesting Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site or rely on its content as a binding offer. We may modify these Terms at any time; the revised version will be posted with an updated effective date. Your continued use constitutes acceptance.
The Site provides general information about residential improvements, showcases example projects, and offers forms for inquiries and email subscriptions. Content is provided for informational purposes and does not constitute professional engineering, architectural, or legal advice unless expressly agreed in a separate written agreement signed by authorized representatives.
Images and project descriptions illustrate typical work and may not represent conditions at your property. A site visit and written scope are required before any binding price or schedule is established.
Any pricing shown on the Site (including package descriptions) is indicative only and subject to change based on measurements, materials, labor conditions, permitting, and unforeseen site conditions discovered during demolition or inspection.
A project becomes binding only when both parties execute a written agreement that specifies scope, price or time-and-materials terms, payment schedule, warranty language, and other material terms. Verbal statements alone do not modify a signed contract.
You agree to:
We strive to meet projected timelines but are not liable for delays caused by weather, material shortages, supplier issues, inspection backlogs, hidden conditions, or events beyond our reasonable control. We will communicate revised expectations when delays occur.
Changes to scope, materials, or layout after work begins must be documented in a written change order describing cost and schedule impact. We are not obligated to perform changes until authorized in writing by you and accepted by us.
Workmanship warranties, if any, will be stated in your project agreement. Manufacturer warranties apply to products and fixtures according to supplier terms. Except as expressly stated in a signed contract, the Site and general marketing content are provided "as is" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or Services. Our aggregate liability for any claim relating to the Site shall not exceed one hundred dollars (USD) unless a different limit is set in a signed project contract.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the minimum extent permitted by law.
You agree to indemnify and hold harmless the Company and its officers, employees, and contractors from claims arising out of your misuse of the Site, inaccurate information you provide, or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
All Site content, including text, graphics, logos, layouts, and photography, is owned by the Company or licensed to us and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without prior written permission, except for personal, non-commercial viewing.
When you submit information through contact, subscribe, or unsubscribe forms, you represent that the information is accurate and that you have the right to provide it. Forms on this static Site display client-side validation and confirmation messages; backend processing may be added in future deployments as described in our Privacy Policy.
If you subscribe to updates, you consent to receive emails about services, promotions, and educational content. You may unsubscribe at any time using the unsubscribe page. We reserve the right to send transactional messages related to active projects or account requests even if you opt out of marketing.
You agree not to:
These Terms are governed by the laws of the state in which the Company primarily conducts business, without regard to conflict-of-law principles. Disputes shall be resolved in the courts located in that jurisdiction, unless otherwise required by applicable consumer protection law.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
For website use, these Terms together with the Privacy Policy constitute the entire agreement between you and the Company regarding the Site. For construction or remodeling work, a signed project agreement controls in the event of conflict with general Site content.
Questions about these Terms may be directed to info@hometowntodowntown.com. We do not publish a street address or phone number on this Site; email is the designated channel for contractual and terms-related inquiries.
